UK Tree Conservation Area Applications
If trees are in a conservation area and are not already covered by a Tree Preservation Order (TPO), by law you must make the Local Planning Authority (LPA) aware that they exist. This is important if you are a UK property developer or developer of other construction work in an area where these trees are. A Tree Conservation Area (TCA) application must be made and this needs to be complete by a qualified arborist tree surgeon in your area.
This application will accurately describe the works that are planned in that area, as well as providing technical descriptions of all the trees that exist in that area. This application must be submitted to the Local Planning Authority no later than 6 weeks prior to the work starting on-site. We would advise getting this done earlier though to prevent any project delays. This is called a ‘section 211 notice’ and it gives any LPA the opportunity to consider protecting the tree with a Tree Preservation Order (TPO).
